A New York judge has declared a mistrial in the third-degree rape trial of former producer Harvey Weinstein because the jury foreman refused to continue deliberations after threats from another juror, the New York Post reports.
"Sometimes jury deliberations get heated. I understand that this particular deliberation was more necessary than others," Judge Farber told the 12-member jury before declaring a mistrial on the rape charge .
The judge indicated that a mistrial was being considered before calling the foreman Thursday morning and asking if he would be willing to join the other panelists after deliberations ceased Wednesday afternoon. The jury foreman, who warned of the alleged threats, assured the judge he could not return to deliberations , precipitating the mistrial. Weinstein , seated in a black wheelchair, clapped three times when the jury refused to return to deliberations.
The mistrial comes one day after the jury convicted Weinstein on one count of criminal sexual assault involving Mimi Haley and acquitted him on another count of criminal sexual assault involving Kaja Sokola . The third count relates to an alleged 2013 assault of aspiring actress Jessica Mann .
